The Secretary of State hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-Up of Highways (County of Derbyshire) (No 6) Order 2004” authorising the stopping-up of a length of highway at Park Lane, Pinxton, Derbyshire, measuring a maximum length of 85 metres. The stopping-up is authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Clarke Homes Ltd, by the Bolsover District Council under Ref 02/00482/FUL. The Order requires the provision of a new highway and the improvement of existing highway by Clarke Homes Ltd, maintainable at public expense, and for which the highway authority is to be the Derbyshire County Council. Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Planning and Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting Ref No EMCM 505035/1/260) and may be inspected at all reasonable hours at the offices of the Pinxton Library, Kirkstead Road, Pinxton, Derbyshire. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 22 September 2004, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
