COURT ORDER RELATING TO INSOLVENCY APPOINTMENTS

Mr Christopher Herron has left Numerica. In the circumstances he has deemed it to be in the interests of Creditors for him to apply to the Court to have the following appointments transferred to Insolvency Practitioners within Numerica to ensure that these appointments continue to be dealt with in an expedient and cost efficient way. In response to Mr Herron’s application the Court ordered, on 3 September 2004, that the Insolvency Practitioners indicated be appointed to the estates indicated below in place of Mr Herron. There is also listed below those joint appointments from which the Court removed Mr Herron without appointing a substitute. Mr Herron has applied to the Secretary of State for his release from each of his above Liquidation and Bankruptcy appointments. The new appointees to the above Compulsory Liquidations and Bankruptcies do not propose to summon a General Meeting of Creditors (or Contributories in the case of the Compulsory Liquidation) for the purpose of establishing a Liquidation/Creditors Committee pursuant to Rule 4.102(6) and section 297(8) of the Insolvency Act 1986. Creditors have the right to request a General Meeting of Creditors to be convened if the request is supported by a minimum of 10% in value of the Company’s/Bankrupt’s Creditors.
