THE ENVIRONMENT AGENCY (INLAND WATERWAYS) ORDER
NOTICE OF APPLICATION FOR AN ORDER

The Environment Agency is applying to the Secretary of State for Environment, Food and Rural Affairs under section 6 of the Transport and Works Act 1992 for the above-mentioned Order under section 3 of that Act. The draft Order would confer new powers upon the Environment Agency, both for the registration and regulation of vessels (including powers for the imposition of third party insurance for vessels and construction and equipment standards) and for levying charges. The new powers would apply in relation to certain waterways for which the Agency is the navigation authority and for enclosed waters adjacent to them. The waterways concerned are: (i) the Agency’s Anglian waterways, including the New River Ancholme, the River Nene Navigation, the Rivers Welland and Glen, the River Stour and the River Great Ouse system incorporating the Great and Little Ouse, Cam, Lark and Wissey; (ii) the river Thames upstream of Teddington lock; (iii) the river Medway above Allington; (iv) the principal stretches of the river Wye above Bigsweir Bridge and the river Lugg. The draft Order would also extend the Anglian waterways for which the Agency is the navigation authority to emcompass that part of the Little Ouse between Brandon Staunch and Brandon Bridge and the Great Ouse Flood Relief Channel between the Head Sluice lock at Denver and the Tail sluice at Saddlebrow. Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for Environment, Food and Rural Affairs c/o the Transport and Works Act Orders Unit, Department for Transport, 9th Floor, Southside, 105 Victoria Street, London SW1E 6DT, on or before 25 November 2004. An objection or representation MUST (i) be received by the Secretary of State on or before 25 November 2004, (ii) be made in writing, (iii) state the grounds of the objection or representation and (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent. The Secretary of State may make objections and other representations public and will copy them to the applicant for the Order.
