TRANSPORT AND WORKS ACT 1992

The Secretary of State for Transport gives notice pursuant to Section 14(1)(b), (3A) and (3AA) of the Transport and Works Act 1992 (“the Act”) that he has determined under section 13(1) of the Act to make with modifications the Margate Pier (Turner Centre) Order (“the Order”).
The Order was applied for by Kent County Council of Sessions House, County Hall, Maidstone, Kent ME14 1XQ (“the Council”). The Order will authorise the Council to construct and maintain an extension to the existing stone pier at Margate Harbour, comprising a new building to be used as an art gallery and for leisure and educational purposes and a vehicular and pedestrian bridge linking that building to the stone pier. The Order would also authorise the construction of mitigation works for wading birds, consisting of a concrete apron located adjacent to the Pier.
In reaching his decision, the Secretary of State has complied with the requirements of paragraphs (a) to (c) of section 14(3A) of the Act about consideration of the environmental statement and of representations relating to it. For the purposes of section 14(3AA) of the Act the Secretary of State is of the opinion that none of the impacts of the proposed works would have major adverse environmental effects.
Copies of the letter setting out the full terms of the Secretary of State’s decision may be obtained from the Transport and Works Act Orders Unit, Department for Transport, Zone 9/09 Southside, 105 Victoria Street, London SW1E 6DT. Copies of the Order (once made) may be obtained from The Stationery Office Limited or through booksellers.
