STOPPING-UP OF HIGHWAYS AT YANWATH NEAR PENRITH IN THE COUNTY OF CUMBRIA

The Secretary of State for Transport gives notice that on the application of Messrs Robinson, Murry, Altham, Cornwell and Donnelly, he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Cumbria) (No 3) Order 2005” authorising the stopping-up of a length of highway at Yanwath Gate Farm, Yanwath near Penrith. This stopping-up Order is permanent and has been authorised to allow the development described in the planning permission granted to Messrs Robinson, Murry, Altham, Cornwell and Donnelly by Eden District Council on 2 July 2004 under Ref 04/0470. Copies of the Order may be obtained, free of charge, on application to the Government Office for the North West (Transport & Planning), City Tower, Piccadilly Plaza, Manchester M1 4BE (quoting Ref GO/TNW 5049/35/1/84). It may also be inspected at all reasonable hours at the offices of Cumbria County Council, The Library, St Andrews Churchyard, Penrith. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the power of the above Act or that any requirement of that Act or of any Regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 6 May 2005, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
