THE ENVIRONMENTAL ACT 1995, SECTION 83(2)
AIR QUALITY VARIATION ORDER 2005
By an Order dated 10 January 2003 Birmingham City Council (“the Council;) made the
Birmingham City Council Air Quality Management Area Order.
Whereas the Council is satisfied that as a result of its Stage 4 Assessment of Air
Quality carried out in 2003, it appears that following the subsequent air quality
review it was unlikely that Birmingham would be able to comply fully with the target
levels for emissions of both nitrous oxide and PM 10 particles by 2010.
Therefore the Council, in exercise of the powers conferred on it by section 83(2)(b)
of the Environment Act 1995, hereby made on 5 May 2005 the following Order varying
the Birmingham City Council Air Quality Management Area Order (“the Order;).
1. The area shown on the attached map to the Order in blue being the whole of the
Birmingham City, which forms part of the Order known as the Air Quality Management
Order shall be varied to include PM10 fine particular matter. The map may be viewed
during normal office hours from Monday to Friday for the next 6 weeks from 17 May
2005 at the Council House, Victoria Square, Birmingham B1 1BB.
2. The Order is known as the Birmingham City Council Air Quality Management Area
Variation Order 2005.
3. The Order came into force on 5 May 2005.
