TRANSPORT AND WORKS ACT 1992

The Secretary of State for Transport gives notice, pursuant to section 14(1)(b) of the Transport and Works Act 1992, that he has determined under section 13(1) of that Act to make with modifications the Greater Manchester (Light Rapid Transit System) Order 2006 (“the Order”). The Order was applied for by the Greater Manchester Passenger Transport Executive, 9 Portland Street, Piccadilly Gardens, Manchester M60 1HX. The Order will modify the Executive’s obligations under the Greater Manchester (Light Rapid Transit System) Act 1988 and later local legislation by replacing requirements in regard to the levels of tram rails laid in streets with a duty of care in relation to the construction and maintenance of tramways in streets or other places to which the public has access. The Order will also provide the Executive with a defence, similar to that available to highway authorities under the Highways Act 1980, in relation to its liability to maintain new or altered streets for 12 months following completion; and will disapply the obligation upon the Executive under section 28 of the Tramways Act 1870 to maintain and repair parts of streets in which a tramway is laid.
