The Secretary of State for Transport hereby gives notice that she has made an Order under section 247 of the above Act entitled “The Stopping Up of Highways (County of Derbyshire) (No.5) Order 2008” authorising the stopping up of highway at Rose Lane, Ticknall, Derbyshire measuring 7 metres in length.

The stopping up is authorised only in order to enable the development described in the schedule to this notice to be carried out in accordance with the planning permission granted to Mr M Wilmot by the South Derbyshire District Council on 20 April 2005 under reference 9/2005/0089/F.

The Order requires the provision of new highway by Mr M Wilmot, maintainable at public expense, and for which the highway authority is to be the Derbyshire County Council.

Copies of the Order may be obtained, free of charge, by applying to the Government Office for the East Midlands, Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG (quoting reference No EMCM 505035/1/282) and may be inspected at all reasonable hours at the offices of the South Derbyshire District Council, Civic Offices, Civic Way, Swadlincote, Derbyshire.

Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 12 May 2008 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

THE SCHEDULE

The erection of a dwelling, the blocking of Rose Lane to Main Street and opening Rose Lane to Ingleby Lane and provision of turning head on Rose Lane.
