PROPOSED HEATHROW AIRTRACK ORDER

NOTICE OF APPLICATION FOR AN ORDER

Heathrow Airport Limited of 130 Wilton Road London SW1V 1LQ, is applying to the Secretary of State for Transport under sections 1 and 5 of the Transport and Works Act 1992, for an Order relating to a new railway providing direct access to Heathrow Airport from south-west London, Surrey and Berkshire.

The Order provides for the re-construction of the existing Staines station and the construction, maintenance and operation of the following works: a new chord line in Staines town centre linking the existing railway line from Staines to Windsor with the lines to Guildford and Reading; a new railway across Staines Moor and Stanwell Moor to Heathrow Terminal 5, including a tunnel between Stanwell Moor and Terminal 5; ancillary works to facilitate the construction of the railways; and provision of a depot for the maintenance and stabling of trains on the former railway marshalling yard at Feltham.

The Order includes provisions for -

1. the construction and maintenance of the proposed works, including provisions relating to streets, including powers to alter the layout of streets and powers to stop up streets permanently and temporarily; replacement and closure of pedestrian level crossings; creation of public paths; protective works to buildings, roads and apparatus; and powers to survey and investigate land;

2. the compulsory acquisition of land for the proposed works and ancillary purposes, including worksites, landscaping and exchange land; the imposition of restrictive covenants or acquisition of easements or other rights only in or over specified land; provisions for the temporary use of land in connection with the construction or maintenance of the works; and the extinction or suspension of private rights of way;

3. the construction of works and the compulsory acquisition and use of land within Staines Common and adjoining open space and the provision and vesting of exchange land; and

4. the lopping of overhanging trees; authority for statutory undertakers to drive over specified footpaths or bridleways; powers to operate and use the railway to enter into agreements with Network Rail Infrastructure Limited and to transfer the undertaking with the consent of the Secretary of State; the disapplication of provisions of the Water Resources Act 1991; the prevention of trespass and the obstruction of the of the works.

The application is to be made subject to an environmental impact assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.

An objection or representation MUST (i) be received by the Secretary of State on or before 18 September 2009, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address.)

The Secretary of State may make complete copies of the objections and other representations public, including any personal information in them, and will copy them to the applicant for the Order.
