Network Rail Infrastructure Limited (“Network Rail”) of King’s Place, 90 York Way, London, N1 9AG, is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992, for an Order under sections 1 and 5 of that Act giving statutory authority to Network Rail for the construction and maintenance of a new chord railway and associated works adjoining the West Coast Main Line railway at Nuneaton in the County of Warwickshire, boroughs of Nuneaton and Bedworth and North Warwickshire.

The Order includes provisions for –

1. the construction and maintenance of the proposed works, including provisions relating to streets, powers to divert Stoney Road and to close or interfere with the Coventry Canal temporarily, and powers to survey and investigate land and to lop trees overhanging the proposed works;

2. the compulsory acquisition of land for the proposed works and ancillary purposes, including worksites and environmental mitigation; the acquisition of rights over specified land; provisions for the temporary use of land in connection with the construction and maintenance of the works; and the extinction and creation of private rights of way.

This application is made subject to an environmental impact assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.
