THE RIVER HUMBER (BURCOM OUTFALL) (TRANSFER) ORDER

NOTICE OF APPLICATION FOR AN ORDER

Tioxide Europe Limited (Tioxide) is applying to the Secretary of State for the Environment, Food and Rural Affairs under section 6 of the Transport and Works Act 1992 for the above-mentioned order under section 3 of that Act.

The draft order makes provision to enable Tioxide and its successors to transfer its rights and obligations under the River Humber Burcom Outfall Act 1986 (the 1986 Act). That Act authorised Tioxide to construct and maintain an outfall in the River Humber notwithstanding the statutory prohibition contained in section 6 of the Humber Conservancy Act 1905 which precludes works beyond certain defined river lines in the Humber. The authority granted by the 1986 Act is personal to Tioxide and hence new powers are needed to authorise a transfer. This is now needed as Tioxide is selling the land which is served by the outfall constructed under the 1986 Act.

The application is not made subject to an environmental impact statement.

Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for the Environment, Food and Rural Affairs, c/o TWA Orders Unit, Department for Transport, Zone 1/31, Great Minster House, 76 Marsham Street, London SW1P 4DR (email: transportandworksact@dft.gsi.gov.uk). An objection or other representation MUST (i) be received by the Secretary of State on or before Thursday 9 December 2010, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give an address to which correspondence relating to the objection or other representation may be sent. If you are sending your objection or other representation by email, please provide a postal address.

The Secretary of Sate may make copies of the objections and other representations public, including any personal information contained in them, and will copy them to the applicant for the order.
