TRANSPORT AND WORKS ACT 1992

The Secretary of State for Energy and Climate Change gives notice pursuant to section 14(1)(b) of the Transport and Works Act 1992 (“the Act”) that he has determined to make, with modifications, The River Humber Neptune Proteus 2011 (“the Order”) using powers in section 3 of the Act. The Order was applied for by Neptune Renewable Energy Limited, 18 High Street, North Ferriby, East Yorkshire HU14 3JP. The Order was made on 21 July 2011 and comes into effect on the date on which this notice is first published in the Gazette.

The Order authorises the construction and operation of a 500W tidal stream generator device in the River Humber adjacent to “The Deep” business centre.

Copies of the letter setting out the full terms of the Secretary of State’s decision may be obtained from the Development Consents and Planning Reform Team, Department of Energy and Climate Change, 3 Whitehall Place, London SW1A 2AW (email: john.swift@decc.gsi.gov.uk). That letter gives the reasons for the determination and the considerations upon which it is based, information about the public participation process and information regarding the right to challenge the validity of the determination and the procedures for doing so. Copies of the Order may be obtained from The Stationery Office Limited or through booksellers.
