As a result of the foregoing, as of 26 th July 2011 Robert Pick is the joint office-holder in respect of the aforementioned cases alongside Simon Thomas (also of Moorfields Corporate Recovery LLP).
Each creditor of the above Administrations, Members’ Voluntary Liquidations, Creditors’ Voluntary Liquidations and Bankruptcies is at liberty to apply to vary or discharge the Order of 26 th July 2011 within 28 days of this advertisement. Those creditors are also at liberty to apply for an Order that Fred Satow and/or Simon Thomas should prepare and provide them with an account of their administration of such insolvencies.
Where Liquidation or Creditors’ committees have been appointed with respect to the aforementioned insolvencies, to the extent that any information which otherwise ought to be provided under Insolvency Rule 4.108(3) or Rule 6.126(2) has not already been provided it is open to that committee to require Fred Satow and/or Simon Thomas to provide an account of their administration of such insolvencies, including a summary of receipts and payments and a statement that they have reconciled their accounts.
Where no such Liquidation or Creditors’ committees have been appointed it is open to any creditor to apply to court for an order that Fred Satow and/or Simon Thomas do provide such information as might otherwise be required by Rule 4.108(3) or Rule 6.126(2) (as the case may be) that is to say, an account of their administration of such insolvencies, including a summary of receipts and payments and a statement that they have reconciled their accounts, provided such an application is made within 28 days of this advertisement.
If Fred Satow and/or Simon Thomas are required to provide the information referred to above the costs of doing so will, unless there are good reasons to the contrary, be paid as an expense of the administration, bankruptcy, or winding up as the case may be.
Each creditor and member (as the case may be) in respect of each of the aforementioned insolvencies has a right under rule 11(1) (compulsory winding up), rule 11(2) (voluntary winding up) or rule 25 of the Insolvency Regulations 1994 (as the case may be) to require the supply of a statement of receipts and payments free of charge.
The remuneration of and the costs and expenses incurred in connection with the application for and the implementation of the Order of 26 th July 2011 which are referable to an individual matter listed in the Schedule to the Order will be fixed and paid in the ordinary way as remuneration of the Liquidator, Administrator or Trustee in Bankruptcy, or as costs and expenses of such liquidation, administration or bankruptcy.
Otherwise, the remuneration of and the costs and expenses incurred in connection with the application for and the implementation of the Order of 26 th July 2011 which are referable to the Application generally will be divided equally between all of the aforementioned insolvencies, and the same will be paid in the ordinary way as remuneration of the Liquidator, Administrator or Trustee, or as costs and expenses of each such liquidation, administration or bankruptcy, PROVIDED THAT in no case will the total of such remuneration, costs and expenses (including VAT) payable as a specific cost and as a general cost shall exceed 10% of the value of the realised assets in that particular matter.
