THE PROPOSED IPSWICH YARD IMPROVEMENT (LAND ACQUISITION) ORDER 201[ ]

NOTICE OF APPLICATION FOR AN ORDER

The Felixstowe Dock and Railway Company (the “Applicant”) of the Port of Felixstowe Tomline House The Dock Felixstowe Suffolk IP11 3SY has applied to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for the above-mentioned Order under sections 1 and 5 of that Act.

The draft Order makes provision for the compulsory acquisition by the Applicant of land and interests in land which are required for the purposes of Work No. 1 the constructing and maintaining an improved marshalling yard in the vicinity of Ipswich Railway Station in the Borough of Ipswich, Suffolk (the “Authorised Works”), authorised by the Felixstowe Branch Line and Ipswich Yard Improvement Order 2008.

The purpose of the above proposed Order is to enable the use of such powers of compulsory acquisition after the time that the equivalent powers in the Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 expire thereby enabling the Applicant to construct and operate the Authorised Works after that time.

The draft Order does not authorise the construction of works.

The application is not to be made subject to an environmental impact assessment.

Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for Transport c/o TWA Orders Unit, General Counsel’s Office, Department for Transport, Zone 1/18, Great Minster House, 33 Horseferry Road, London, SW1P 4DR or email: transportandworksact@dft.gsi.gov.uk. An objection or other representation MUST (i) be received by the Secretary of State on or before 2 December 2011, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give and address to which correspondence relating to the objection or other representation may be sent. (If you are sending your objection or other representation by email, please provide a postal address).

The Secretary of State may make complete copies of the objections and other representations public, including any personal information contained in them, and will copy them to the Applicant for the Order.
