THE CROSSRAIL (KENSAL GREEN) ORDER
NOTICE OF APPLICATION FOR AN ORDER
Crossrail Limited of 25 Canada Square, Canary Wharf, London E14 5LQ is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for the above-mentioned order under section 1 of that Act.
The draft order makes provision for the temporary possession of land at the site of former gas works at Kensal Green in the Royal Borough of Kensington & Chelsea and for the provision of a temporary working site and access required for the construction of certain works in connection with the Crossrail project authorised to be constructed under the Crossrail Act 2008. In connection with the above-mentioned purposes, the draft order provides for the provision of access to works, the discharge of water, the power to survey and investigate land, the temporary suspension of private rights of way, the temporary stopping up of Canal Way, the power to execute street works, the application of provisions of the Compulsory Purchase Act 1965 to the temporary use of land authorised under the draft order, a time limit for the exercise of powers of temporary possession, the modification of provisions in an agreement and deed of grant relating to Canal Way, a defence to proceedings in respect of statutory nuisance, the prevention of obstruction of the construction of works and ancillary provisions.
The application is to be made subject to an environmental impact assessment.
The application contains a statement that a direction for deemed planning permission is being applied for.
A copy of the application, and of all plans and other documents submitted with it, may be inspected free of charge from 5 March 2012 to 18 April 2012 between the hours of 9:30am and 8pm on Mondays, Tuesdays and Thursdays and between the hours of 9:30am and 5pm on Wednesdays, Fridays and Saturdays at North Kensington Library, 108 Ladbroke Grove, London W11 1PZ and between the hours of 9am and 5:30pm Monday to Friday at the offices of Crossrail (Tel. 0203 229 9100) at 25 Canada Square, Canary Wharf, London E14 5LQ. Copies of that information may be obtained from Crossrail Limited, (FAO Clive Edwards), 25 Canada Square, Canary Wharf, London E14 5LQ. A charge may be payable.
Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for Transport c/o Transport and Works Act Orders Unit, General Counsel’s Office, Department for Transport, Zone 1/18, Great Minster House, 33 Horseferry Road, London SW1P 4DR (e-mail: transportandworksact@dft.gsi.gov.uk). An objection or other representation MUST (i) be received by the Secretary of State on or before 18 April 2012, (ii) be made in writing (whether sent by post or e-mail), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give an address to which correspondence relating to the objection or other representation may be sent. The Secretary of State may make complete copies of the objections and other representations public, including any personal information contained in them, and will copy them to the applicant for the order.
