LONDON LOCAL AUTHORITIES AND TRANSPORT FOR LONDON ACT 2008
ENFORCEMENT AGAINST PERSISTENT EVADERS OF PARKING PENALTIES
Notice is hereby given that the Council of the London Borough of Haringey resolved on 18th March 2013 to exercise the powers conferred by Section 5 of the London Local Authorities and Transport for London Act 2008.
The general effect of the provisions of the aforesaid Act is to confer further powers to recover any outstanding unpaid parking penalties from persistent evaders of such penalties. A general definition of a persistent evader is a vehicle with three or more unpaid penalties that have passed the date by which an appeal can be made.
The further powers include the following:—
• If a persistent evader is located, it may be immobilised and removed to a car pound even if it is not parked in contravention of parking regulations;
• A persistent evader’s vehicle may not be released from an immobilisation device or a car pound until all outstanding penalties and additional charges have been paid or, where applicable, a bond is paid and the owner provides the required documentary evidence.
The Council has resolved to commence operation of these powers with effect from 2 May 2013.
