PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990, SECTION 69
BILLERICAY CONSERVATION AREA
NOTICE is given under the provisions of the above Act that Basildon Borough Council as local planning authority has determined that the area described and shown on a plan in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. It has therefore reviewed the Billericay Conservation Area to exclude selected properties in St James’ Close, Western Road, Western Mews, Chandlers Chase, Lion Lane, St Edith’s Lane, Quilters Drive and Archers Close.
The principal effects of this are as follows:
1. The Council is under a duty to prepare proposals to ensure the preservation or enhancement of the area;
2. In carrying out its functions under the Planning Acts, and in particular determining applications for planning permission and listed building consent, the Council and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area;
3. Consent must be obtained from the Council for the demolition of any building in the area;
4. Special publicity must be given to planning applications for development in the area;
5. Six weeks’ notice must be given to planning applications for development in the area;
6. Trees within the Conservation Area are given special protection. It is an offence to cut down, lop, top or uproot a tree, subject to certain exceptions, within the Conservation Area without giving at least 6 weeks notice of intent in writing to the local planning authority; and
7. Conservation Areas are classed as Article 1(5) land under the General (Permitted Development) Order and consent must be obtained from the Council for certain developments that would normally not require planning permission.
